These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, programs, classes, workshops, events, website, and related offerings provided by MapleHue Painting Studio Ltd. (“MapleHue Painting Studio Ltd.”, “we”, “us”, or “our”), a painting-studio business located at 2185 West 4th Avenue, Suite 302, Vancouver, BC V6K 1N7, Canada.
By registering for, purchasing, attending, or otherwise using any of our services, including beginner painting classes, acrylic painting workshops, watercolor technique sessions, private art lessons, corporate team-building paint events, and kids' creative painting camps, you agree to be bound by these Terms. If you do not agree, you must not use our services.
If you are accepting these Terms on behalf of another person, a minor, or an organization, you represent and warrant that you have authority to bind that person or organization to these Terms.
2. Scope of Services
MapleHue Painting Studio Ltd. provides creative art instruction and event-based painting experiences, which may include:
- Beginner painting classes
- Acrylic painting workshops
- Watercolor technique sessions
- Private art lessons
- Corporate team-building paint events
- Kids' creative painting camps
We may offer services in-studio, at off-site locations, or through online or hybrid formats. Specific details, schedules, age requirements, materials, fees, duration, and participation limits may vary by program and will be communicated at the time of booking or registration.
We reserve the right to modify, suspend, or discontinue any service, class, instructor, venue, or program content at any time in our discretion, subject to applicable law and any express refund or rescheduling commitments stated at the time of purchase.
3. User Obligations and Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete registration and payment information.
- Comply with all studio rules, safety instructions, instructor directions, and venue policies.
- Arrive on time and be prepared for participation, including wearing suitable clothing for art activities.
- Use materials, equipment, and studio property carefully and responsibly.
- Refrain from disruptive, abusive, discriminatory, unsafe, unlawful, or harassing conduct.
- Not attend any session while under the influence of alcohol, drugs, or any substance that may impair safety or behavior, unless expressly permitted for a specific event and lawful under applicable rules.
- Supervise minors in accordance with any program requirements and ensure that minors are picked up on time and only by authorized persons.
- Immediately inform us of any medical condition, allergy, disability accommodation need, or safety concern that may affect participation.
You acknowledge that art activities may involve paint, brushes, easels, water, cleaning products, floor surfaces that may become slippery, and other materials that can stain clothing or cause minor injury if used improperly. You are responsible for following instructions and using reasonable care.
You are responsible for any damage you or your guests cause to our property, equipment, supplies, or venue, other than ordinary wear and tear.
4. Payment Terms and Conditions
All fees, taxes, and applicable charges are due in the manner specified at the time of booking or registration. Prices may be listed in Canadian dollars (CAD) unless otherwise stated.
- Full payment may be required in advance to secure your reservation.
- We may accept payment by credit card, debit card, electronic transfer, or other approved methods.
- All payments must be authorized by the cardholder or account holder.
- Any applicable taxes, including GST, PST, HST, or other taxes, will be added as required by law.
- Chargebacks or payment disputes made in bad faith may result in suspension or denial of future services.
If a payment fails, is reversed, or is otherwise not received, we may cancel the booking, suspend access to services, or require immediate payment before participation.
Promotional pricing, discounts, gift certificates, coupons, and credits may be subject to additional terms, expiration dates, and restrictions and may not be combined unless expressly stated.
5. Cancellation and Refund Policy
Cancellation and refund terms may vary depending on the type of service, booking method, and whether custom materials, staffing, or venue arrangements have already been secured. Unless a different written policy is provided for a specific event or program, the following general policy applies:
- Individual classes and workshops: Cancellations made at least 72 hours before the scheduled start time may be eligible for a refund or rescheduling, at our discretion, less any non-recoverable processing fees where permitted by law.
- Private lessons: Cancellations made at least 72 hours before the appointment may be rescheduled once, subject to availability. Late cancellations may be charged in full.
- Corporate events and group bookings: Deposits may be non-refundable. Any balance due may remain payable for cancellations made after materials or staffing have been arranged.
- Kids' camps and multi-day programs: Cancellation terms will be stated during registration; space reservations, supplies, and staffing may limit refund eligibility.
- No-shows: Failure to attend without notice is generally not refundable or transferable.
If we cancel a class, workshop, lesson, or event for operational reasons, we may, at our discretion, offer a reschedule, store credit, or refund for the affected portion of the fee, except where cancellation is due to force majeure or circumstances beyond our reasonable control, in which case Section 9 applies.
To request a cancellation, you must contact us using the contact details in Section 12. Refunds, if approved, will generally be issued to the original payment method, subject to processing timelines of the relevant financial institution.
6. Liability Limitations
To the fullest extent permitted by applicable Canadian law, including the laws of British Columbia and any mandatory consumer protection legislation, MapleHue Painting Studio Ltd., its directors, officers, employees, instructors, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, loss of data, loss of goodwill, or business interruption arising from or related to your use of our services.
Our total aggregate liability for any claim arising out of or relating to the services, whether in contract, tort, negligence, strict liability, or otherwise, shall not exceed the amount paid by you to MapleHue Painting Studio Ltd. for the specific service giving rise to the claim, to the extent permitted by law.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence where such limitation is prohibited, or liability for fraud, wilful misconduct, or any other matter that cannot legally be excluded.
You acknowledge that participation in art activities may involve some inherent risks, including minor accidents, allergic reactions to materials, spills, slips, or property damage. You voluntarily assume these risks to the extent permitted by law.
7. Intellectual Property Rights
Unless otherwise agreed in writing, all content created, developed, displayed, or provided by MapleHue Painting Studio Ltd., including lesson plans, curriculum materials, images, logos, text, graphics, designs, videos, templates, and instructional materials, remains the property of MapleHue Painting Studio Ltd. or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, upload, transmit, sell, sublicense, or otherwise exploit our content without our prior written consent, except for personal, non-commercial use as expressly permitted by us.
Any artwork created by you during a class or workshop is generally owned by you, subject to the following:
- We may display, photograph, or feature completed artwork for promotional or archival purposes only with appropriate consent where required by law.
- We retain ownership of our teaching methods, compositions, templates, and original instructional materials.
- If a specific project uses licensed or third-party content, use may be subject to the rights of the applicable rights holder.
By submitting testimonials, feedback, images, or other content to us, you grant MapleHue Painting Studio Ltd. a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute such content for business, marketing, and operational purposes, subject to applicable law and any privacy consents required for personal information.
8. Data Protection and Privacy
We collect, use, disclose, and store personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, British Columbia privacy laws.
Personal information may include your name, contact details, billing information, emergency contacts, health or allergy information you voluntarily provide, attendance records, and communications with us. We use this information to:
- Process registrations, payments, and bookings;
- Provide services and customer support;
- Communicate schedules, updates, and safety notices;
- Maintain business and financial records;
- Comply with legal and regulatory obligations;
- Improve our services and operations.

In the event of force majeure, we may cancel, reschedule, modify, or relocate a service, and our obligations may be suspended for the duration of the event to the extent reasonably necessary.

We may update or revise these Terms from time to time to reflect changes in our services, operations, legal requirements, or business practices. The revised Terms will be effective upon posting or upon the date stated in the updated version, as applicable.
Your continued use of our services after any update constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
11. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
Subject to any mandatory consumer protection rights or other non-waivable legal requirements, you agree that the courts located in Vancouver, British Columbia shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of our services.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be interpreted to achieve, to the maximum extent possible, its intended purpose, and the remaining provisions shall continue in full force and effect.
If any invalid, illegal, or unenforceable provision cannot be modified to make it valid and enforceable, it shall be severed from these Terms, and the remainder of the Terms shall remain binding and enforceable.
